Filing a Takedown Notice

If you own the copyright in material that appears on this site without authorisation, or you are authorised to act for the owner, send us a written notice containing all six of the following. A notice missing any of them may not be effective under the statute:

  • Identification of the copyrighted work you claim has been infringed. If the notice covers several works at one site, a representative list of them is sufficient.
  • Identification of the material you say is infringing, described specifically enough for us to locate it — please include the full URL of every page concerned.
  • Your contact information: name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner’s behalf.
  • Your physical or electronic signature.

What Happens Next

On receiving a notice that complies with the statute, we will act expeditiously to remove or disable access to the material identified, and will take reasonable steps to notify whoever posted it. We may remove material while a dispute is being resolved; doing so is not an admission of liability or a finding that infringement occurred.

Because this site publishes only its own editorial content and does not host user-submitted material, most notices we receive concern quotations, images or attribution. If you think we have credited or licensed something incorrectly, telling us informally at the same address is often the fastest way to get it fixed, and we would rather correct an error than argue about it.

Counter-Notification

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notification. It must include all of the following:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location at which it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address and telephone number, together with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who filed the original notice or their agent.

If we receive a valid counter-notification, we may forward it to the original complainant and may restore the material in accordance with the timescales set out in the statute, unless the complainant informs us that they have filed an action seeking a court order.

Repeat Infringers

We maintain a policy of terminating, in appropriate circumstances, the access or participation of anyone who is determined to be a repeat infringer.

Misrepresentation

Be aware that under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and legal fees. Please be sure of your position — and, if you are unsure whether a use is infringing or is permitted as fair use, consider seeking legal advice before filing.
